Hangzhou Hikstorage Technology Co., LTD. RMA POLICY
1. Document Purpose and Scope: This document addresses RMA policies applicable to the products purchased by customers (“Customers”) that are returned to Hangzhou Hikstorage Technology Co. Ltd. (“Hikstorage”) for repair or replacement. To the extent that governing law where the sale of product took place is inconsistent with a provision herein, and such governing law prohibit waiver by contractual agreement, then such governing law shall apply only to the extent of the inconsistency. Any exceptions to this Policy requested by Customers must be approved in writing by Hikstorage.
2. Amending this Policy: Hikstorage may amend the Policy from time to time, in part or entirety, without prior notice.
3. Hikstorage’s Responsibility: Except as otherwise agreed by the parties, Hikstorage’s sole responsibility under Hikstorage’s warranty is limited to repairing or replacing the defective products returned by Customers if the product is still within the warranty period. For details on the product warranty provided by Hikstorage, please refer to the following:

* Warranty period for the peripheral such as hard disk drives shall be subject to the warranty period which is provided at the time of purchase of such equipment.
* Warranty period for Consumer, Industrial, Enterprise and Surveillance SSD products, whichever occurs first: 1) Three years from the date of purchase by the original customer, or 2) The standard service life of the memory card is exceeded, inspected by S.M.A.R.T. (Self-Monitoring, Analysis and Reporting Technology) tool. Disassembly or man-made damage of products is not covered by the warranty , including but not limited to: product label tearing; unpacking of the shell ;Shell breakage/SAG/scratch/wear (no impact on hard disk body); IC missing, IC drop, IC breakage rejection repair; Transfer card burned, fractured, artificially scratched, etc..
* Warranty period for consumer memory card products, whichever occurs first: 1) Seven years from the date of purchase by the original customer, or 2) The standard service life of the memory card is exceeded, inspected by S.M.A.R.T. (Self-Monitoring, Analysis and Reporting Technology) tool.
* Warranty period for surveillance memory card products, whichever occurs first: 1) Two years from the date of purchase by the original customer, or 2) The standard service life of the memory card is exceeded, inspected by S.M.A.R.T. (Self-Monitoring, Analysis and Reporting Technology) tool.
* The warranty does not cover use of Consumer memory card and SSD or HDD products in relation to the following occasions or devices (as defined by Hikstorage): (1) normal wear and tear, drop, (2) IP and network cameras, (3) display devices for loop playback, (4) video monitoring, security and surveillance devices, (5) on-board recording devices and dashcams, (6) continuous recording devices, (7) continuous data storage devices such as servers, or (8) other overuse that exceed standard range of application defined in manuals.
4. Warranty Scope: Hikstorage's products in any of the following circumstances are excluded from Hikstorage's free-of-charge warranty. However, users may choose Out-of-warranty repairs.
4.1 Valid warranty document and original purchase invoice or receipt cannot be shown, and the former serial number label is altered, changed or torn down, there is no serial number or the product model or number on the warranty document is inconsistent with the product.
4.2 The warranty period specified by HIKSTORAGE is exceeded.
4.3 Malfunctions and damages resulting from failure of use, maintenance and storage according to the user manual or the working environment indicated in the user manual.
4.4 Malfunctions or damages resulting from installation, repairs, changes or dis-assembly by the organizations NOT authorized by Hikstorage.
4.5 Damages resulting from accidents or other force majeure.
5. Limitation of Liability:If Hikstorage breaches the contract or needs to bear other responsibilities, customers can request Hikstorage to compensate for the losses. However, the compensation liability of Hikstorage is limited to customers actual direct losses and does not assume any responsibility for the following:
① the amount exceeding the actual payment price for the product customers purchased;
② Any costs and expenses related to obtaining alternative goods, technology, services, or rights;
③ Data damage or loss;
④ Losses caused by interruptions or delays in use.
This liability limitation also applies to product sellers and service providers. This is the maximum compensation limit jointly borne by Hikstorage and product sellers and service providers. The above liability limitations apply only to the extent permitted by law and do not apply to liabilities that cannot be excluded or limited by contract or other means in accordance with the law.
